Is Weed Smoking Legal Or Is It Just Tolerated In Colorado?

It's 100% legal now, within some limits. Wikipedia summarizes the situation clearly:

Adults 21 and older can grow up to three immature and three mature cannabis plants privately in a locked room, legally own all cannabis from the plants they grow (as long as it stays where it was grown), legally own up to an ounce of cannabis when traveling and as a gift up to one ounce to other citizens aged 21 and over. Consumption is permitted in a similar manner to alcohol, with equivalent offenses being prohibited for driving. Public consumption remains illegal.

The only big difference from Amsterdam is that, unlike Dam's coffeeshops, you can find it in the stores that sell it or in other stores that are open to the public. no Can smoke pot. In practice, this means that the only place you can smoke legally is at your home (or with someone else with their permission).

This article provides more practical details including an important note that without a Colorado ID, you can only purchase ~ 7 g (1/4 oz) from one store. Bringing cannabis to the airport is illegal too, and removing it from state lines is also a bad idea (because it's illegal everywhere except soon in Washington).


It is also important to note that marijuana possession is still one Federal crimes and that that law is still applicable in Colorado. The Justice Department has announced that they will turn a blind eye for the time being, but until the conflict between federal law and new state regulations is resolved, they will be on shaky feet - especially every 4 or 8 years when the White House changes hands.


It's true, but the dynamic is pretty clear now. I can't really see the Fed cracking down anytime soon.


Can you fly to CO, buy some weeds and fly back to another state with the weeds (say they want to be ready to smoke when they go back to CO because the plants would have died of neglect in the meantime)? ?


And is the 3-plant rule per adult? per family?
